Bahamas Judge rules Stern cana??t flee with Dannielynn After frantic pleas by Anna Nicole Smitha??s mother, a Bahamian judge yesterday slapped Howard K. Stern with a court order preventing him from whisking the late centerfolda??s baby out of the Caribbean country. Smitha??s mom, Virgie Arthur, begged the court to take action, saying she fears for the safety of her 5-month-old granddaughter as long as baby Dannielynn remains with Stern. Justice Stephen Isaacs granted the grandmothera??s request for an injunction preventing Stern - who is listed as the father on Dannielynna??s birth certificate - from taking her out of the Bahamas. Smitha??s ex-boyfriend Larry Birkhead, 34, also claims to be the babya??s dad. Hea??s fighting for paternity rights in a Los Angeles court. A hearing is set for Tuesday. Arthur, who believes Birkhead is the real dad, said she longs for her grandchild. a??Ia??d like to see the baby. Ia??d like to see Larry have the child.a?? Arthur declined further comment, but her friend David Lee explained that she blames Stern for the deaths of her daughter and grandson, Daniel Smith. a??Therea??s two common denominators in the deaths of her daughter and her grandchild - drugs and Howard K. Stern,a?? Lee said. Stern was present when Daniel, 20, died of a drug overdose in his moma??s Nassau maternity ward room Sept. 10 - just three days after Dannielynna??s birth. The lawyer was staying with the former reality TV star in a Florida hotel when the 39-year-old suddenly dropped dead, surrounded by pill bottles, last Thursday. a??She [Arthur] will do whatever she can to get this child away from the man [she blames] for two deaths,a?? Lee said. a??She is very, very fearful for the childa??s safety.a?? Bahamian authorities say Stern, 38, could face more grilling about Daniela??s death now that the young mana??s mother has died under similar circumstances. a??Because of the incident that happened in the U.S. with Annaa??s death, I think we would want to talk to him again,a?? chief magistrate Roger Gomez told the Daily News. Regarding reports that methadone was found in the refrigerator of Smitha??s Nassau home, Gomez said, a??I know that police will be interested in that because methadone was one of the drugs that contributed to Daniela??s death.a?? An inquest is scheduled next month. In Miami, a new battle is brewing over Smitha??s corpse, which remains in a Broward County morgue until key legal issues are resolved. Arthur wants to claim the body and have a funeral as soon as possible, the celebrity news Web site TMZ.com reported yesterday. But a California judge has ordered Smitha??s body preserved for possible DNA testing until at least Feb. 20 - the date of Birkheada??s paternity hearing. a??Ita??s all a tragic mess and nothing can or will be resolved until the DNA test is done,a?? said a Birkhead relative in Kentucky. Smith had undergone a a??commitmenta?? ceremony with Stern. But since she was not married when she died, the baby is her legal next of kin and heir, followed by Arthur. But whoever is determined to be the babya??s father, if a court awards him parental rights, might be authorized to claim Smitha??s body on Dannielynna??s behalf - leaving Smitha??s mom out in the cold.
